Since the issue raised in all the Revisions is one and the same, they are being disposed of by this common judgment

All these appeais arise out of the common judgment dated 16.05.2014 passed in Crl. Appeal Nos. 49 I of 2071 and 83 of 2Ol2 on the file of II Additional Metropolitan Sessions Judge, Hyderabad to the extent of modification order in D.V.C. No.67 of 20 10 on the file of I Metropolitan Magistrate at Hyderabad.

Brief facts of the case are that initialiy petitioner/ wife filed D.V.C. No. 67 of 2010 on the fiIe of I Metropolitan Magistrate at Hyderabad seeking different reliefs under Section I 2 of the Protection of Women from Domestic Violence Act, 20O5 (for short, 'the Act'). The marriage of petitioner was performed with the respondent on 17.02.2006. As per the demand of the respondent, the parents of the petitioner gave an amount of Rs.10,0O,000/- as dowry to the respondent i.e. Rs.5,O0,000/ in cash, and another Rs.5,00,000/- by way of two cheques bearing

Nos.141618 dated 31.01.2006 for Rs.2,00,000/- and cheque bearing No.141619 dated 08.02.2006 for Rs.3,O0,OOO/- drawn at Indian Overseas Bank, Himyathnagar Branch, Hyderabad in favour of father of husband of the petitioner and a-lso presented other household articles, gold ornaments, furniture and gifts total worth Rs.13,00,000/-. Thereafter the respondent started harassing the petitioner mentally and physically for want of additional dowry of Rs.2,00,000/-. Out of the wedlock the petitioner blessed with a male child on 28.O3.2OO7.

The petitioner/wife further submits that on 21.O4.2OO8 the respondent necked out the petitioner from his house by retaining her minor son and again demanded the said additional dowry. The petitioner filed a complaint before the Women Police Station, Central Zone and the police registered a case in Cr.No.l29 of 2008 against the respondent ald his family members.

The petitioner filed W.P. No.12479 of 2OO8 before this Court seeking custody of her minor son. Accordingly, as per the orders of this Court the respondent handed over her minor son to her custody. The respondent is having sufficient means and

earning a sum of Rs.3O,000 l- pe, month. The petitioner is taking care of her minor child, as such she is unable to attend any job and they are fully depending upon her parents and she requires maintenalce of Rs.20,0OO/- per month to maintain her minor son and herself

Learned I Metropolitan Magistrate, Hyderabad after considering oral and documentary evidence adduced by both parties allowed the D.V.C. No.67 of 2010 in part, directed the respondent/husband to pay Rs.5,OO0/- per month to the petitioner and Rs.2,00O/- per month to her minor son towards their monthly maintenance apart from granting alternative accommodation for the petitioner and her son in the shared household and dismissed the rest of the reliefs prayed by the petitioner/wife

7 . Petitioner/wife preferred appeal uide Crl. Appeal No.83 of 2Ol2 against the order dated 01.08.2O11 in DVC No.67 of 2OlO contending that the learned trial Court did not appreciate the facts and law and passed erroneous order though she paid Rs.10,00,000/- to the respondent towards dowry by way of cash and two cheques and did not consider returning of her gold,

household articles, furniture and gifts etc., which were presented at the time of her marriage.

Whereas the respondent/husband in D.V.C. No.67 of 2010 preferred the appeal uide Crl. Appeal No.491 of 2Ol1 assailing the order dated 01.08.2011 passed in DVC No.67 of 2010 on the file of I Metropolitan Magistrate, Hyderabad contending that the learned trial Court passed orders contrary to law and facts and the maintenance awarded is exorbitant, without considering his financial capacity and also alternative accommodation for the petitioner and her son in the shared household within 30 days from the date of order

9 . The learned appellate Court after considering entire material on record dismissed the Crl. Appeal No.83 of 2012 filed by the respondent/husband and partly allowed the Criminal Appeal No.491 of 2Ol1 directing the respondent Nos.1 to 3 to return the dowry amount of Rs.5,OO,0OOI- to the petitioner within 30 days from the date of order and further directed to pay a sum of Rs.B,OOO/ to the petitioner towards rentals for securing proper accommodation on rental basis for her separate residence from June, 2O14 onwards.

1O. Learned counsel for the petitioners/ respondents herein, who are husband and father-in-law of the petitioner in DVC No.67 of 2010, filed the Crl. Revision Case No.1465 of 2Ol4 challenging the Criminal Appeal No.491 of 2O11, dated 16.O5.2OI4 passed by II Addl. Metropolitan and Sessions Judge, Hyderabad that the learned appellate Court erred in modifying the order of the I Metropolitan Magistrate, Hyderabad without considering the financial soundness of the petitioner/wife as she is plasticising as Pharmacist and earning sufficient amounts. He further contended that the appellate Court does not have power to order for return of the dowry under Section 19 ofthe Act.

Learned counsel for the petitioners/ respondents herein, who are husband of the petitioner and his family members as shown in DVC No.67 of 2010, filed the Crl. Revision Case No.1485 of 2Ol4 challenging the Criminal Appeal No.49l of 2011, dated 16.05.2014 passed by II Addl. Metropolitan and Sessions Judge, Hyderabad that the learned appellate Court erred in granting residential order and return of alleged dowry

amount when the petitioner/wife/ P.W.1 herself voluntarily left the company of the respondent/husband and further contended that that the appellate Court erred in granting relief under Section 19 (8) of the Act, which does not contemplate to return the dowry amount and prayed to allow the revision

Learned counsel for the petitioner/wife filed the Criminal Revision Case No.413 of 2015 questioning the Criminal Appeal No.491 of 2071, dated 16.05.2014 passed by II Addl. Metropolitan and Sessions Judge, Hyderabad that the appellate Court's finding is contrary to the settled principles of law and evidencd on record and that the awarded maintenance is very meagre as the Court below did not consider that the respondent/husband is a Dentist and earning more than Rs.3O,OOO/- per month apart from his father is earning Rs.7O,OOO/- per month on business and prayed for review the judgment of the appellate Court.

The learned Public Prosecutor would submit that the common order passed by the appellate Court in Criminal Appeal

Nos.491l2011 and 83/2012, dated 16.05.2074 in right perspective manner and needs no interference.

On the other hand, Ms. Kiranmayee, learned counsel representing on behalf of the revision petitioners Mr. P. Sri Harsha Reddy would submit that this Court granted interim stay of payment or claim for Rs.5,00,0OO/- and Rs.5,000/- to the residence provision and directed the 1"t revision petitioner to pay maintenance of Rs.7,000/ per month and residence provision of Rs.5,000/- per month to the petitioner/wife

On perusal of the entire record, it is noticed that till today the interim order passed by this Court has not been complied with by the 1"t revision petitioner even after lapse of nine years The learned counsel for the respondents would submit that they are not having sufflcient means to maintain themselves and only upon examining the case on merits, learned appellate Court has passed the order, S such, interference does not warranted.

Learned Public Prosecutor would submit that it is borne on record that in spite of elapsing nine years, the order passed by the appellate Court has not been complied with and on the other hand the respondent and her son are suffering for want of maintenance. The 1st revision petitioner does not have responsibilit5r to the order of this Court and the revision petitioner has not demonstrated that he has complied with the orders of this Court to prove his case. Hence, seeks to dismiss the petition.

Having considered the rivai submissions and after going through the material evidence on record, this Court is of the opinion that the order passed by the appellate Court uid_e order dated 16.05.2014 in Criminal Appeal No.491 of 2O11 and 83 of 2012 on the Iile of II Addl. Metropolitan Sessions Judge, Hyderabad has been passed after examining and scrutin izing tlne evidence before it and by examining the orai and documentary evidence the lower Court ald upon hearing both parties passed the reasoned order. Further the proceedings made in the Writ petition No.72429 of 20Og does not have bearing on these criminal Revision cases. It is also a fact that the lst revision petitioner in Crl. Revision Case No.1465 of 2014 has not compiied with the interim order passed by this Court till todav.

That itself is suff,rcient to dismiss^these Criminal^{RevisionCases.} Hence, this Court is not inclined to interfere^{with the hnding of the} learned appellate Court
