Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the Affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or direction more in the nature of Mandamus declaring the Preliminary Land Acquisition Notification issued by the Respondent No.1 in S.R.L.l.P.Rc.No.Bl222l2O18 dated 24-8-2018 for payment of compensation to 30 non{ribal (S.Cs) for an extent of Ac.37-13 gts situated at Julurupadu Village, Julurupadu Mandal of Bhadradri Kothagudem District, is illegal, arbitrary and contrary to Section 2 Clause (g) and Section 3 of A.P.(T.S) (Scheduled Areas ) Land Transfer Regulation, 1959 and its Amendment 1 of 1970 and contrary to the law laid down by the Honorable Supreme Court of lndia reported in AIR 1988 SC 1626 ( P.Rami Reddy etc. Vs. State of Andhra Pradesh), 1997 (8) SCC 191 and consequently declare that the State cannot provide any compensation or any benefit under Right to Fair Compen'sation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 to the 30 non-tribal (S.Cs).
