This writ petition has been filed to issue a Writ, Order or Direction, more particularly one in the nature of a Writ of mandamus declaring the action of the l"t respondent-company in issuing proceedings reference No. BHP/KTKOC-3/WO- 18/ 2O2l /57:-36, dated. 21.I2.2O2t, rejecting dependent employment to the lst petitioner stating that the l"t petitioner's age is 4O years as per the age assessment committee and that as per the lst respondent company's records i,e., date of birth of the l"t petitioner, who is the son of the exemployee i.e., the 2nd petitioner herein, is 01.08.1979 and not 15.06.1988 as claimed by him, even after verifying the SSC Certificate, school records, Community records and ect., as illegal and against the Mines Act, 1952 and its Rules 1955 and National coal Wages Agreement and its implementing instructions and consequently to declare that the 1st petitioner is having valid date of birth 15.06.1988 as per the Seconddry School Certihcate and other records and further to declare that petitioner is entitled for all statutory benefits including : dependent emplo5rment under Mines Act, 1952 and its Rules 1955 and National Coal Wages Agreement, and to pass such other order (or)
