Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the 1st respondent bank in obtaining the orders in Crl.M.P.No.64412019 dt. 3-9-2019 on the file of the Chief Metropolitan Magistrate, Cyberabad, L.B.Nagar, R.R.District, appointing the 2nd respondent as an Advocate Commissioner to take the physical possession of the property bearing H.No. 2-6-10/C and 2-6-10/D on land admeasuring 120 Sq. Yards situated at Jayapuri Colony, Nagole village, Uppal Revenue Mandal, R.R.District, without following the procedure contemplated U/Sec. 13(2) and 13(4) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Ac1,2002, and consequently set aside the same by directing the 1st respondent to grant time till the end of December, 2019 for payment of the arrears of loan installments and to continue to pay the same by regularizing the loan account a/c No. 60241812013 and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case.
