Heard the learned^{counsel for the appellants/claimants and Sri} D.Kiran, learned Assistant^{Government Pleader lor AppealsPeruscd} the material available^{on record.}

The main contention of^{the learned counsel for the claimantsis} that even under the Government^{Orders i.e., G.O.Ms.No.234, dated} 15.10.1993, marked as Ex.A9, the^{Governmenthas passedorders} granting compensation 1+2 times for the houses /^{structures acquired} in respect of Srisailam Project. It is^{submittedthat inasmuch as the} present acquisition of the houses/ structures of the^{claimants also for} the purpose of irrigation^project i.e.,^{Priyadarshini JooralaProject,} Ex.A9 is equally applies to the case of the claimants^{and therefore, the} learned counsel seeks to enhance the market^{value ofthe} compensation 1+2 times than^{what was} awarded^{by the L.A.O.}

Anugonda Village , '.he reference Court has passed orders in O.P.No.29 of 2OO4 and Batch. dated 23.O1.2006 .nirancing the marke[ value by one time morc tl-ran the value fixed by thr: L.A.O. The said order rvas marked as Ex.A7. lnasmuch as the pres(-nt acquisition proceedings relates to the adjacent village covered by Ex.A7, the reference Court relying on Ex.A7 has lixed thc market value bv one time more than the value hxed by thc L.A.O. Although the learncd Assistant Government Pleader submits that this projcct is eniirely different one and the said G.O. covered by Ex.A9 which u,as issucd for Srisailam project cannot be applicd iir the absence ol an1, specific G.O. issued for the present project, this Court is not inclined to accept the said contention for the reason that the present acquisition proceedings also pertains to Irrigation purpcse. Even the other contention of the learned Assistant Government Pleader that under Ex.A4, the Apex Court has conhrmed the earlier fixation of market value by reference Court by one more time (1+ 1) tltan the one f-xed by the I-.A.O. and therefore, the present enhancement made by the reference Court which is in tune with Ex.A4 cannot be disturbed is also unsustainable for the reason that Ex.A9 issued by the Government granting I +2 has not been brought to the notice of the Apex Court.

It is relevant to refer clause (ii) of Ex.A9, which specifies that^.fhe market ualue of the stntctures including well uthich has been treated. as sttucture by the Lond Aquisition OJficer in his auard; and house sites shall be frxed at three times the ualue (1+2) determined by the Land Acquisition Officers." Even though Ex.A9 pertains to the acquisition proceedings in respect of Srisailam Project, the benefit thereol cannot be denied to the present appellants on the mere ground that the
