This Criminal Petition is hlecl^seeking to^relaxthc condition imposed in Crl.M.P.No.883^{of 2O2l in C.C.No.15760ol} 2019, on the file of XIII Additional Chief^{MetropolitanMagistrate} at Hyderabad by deleting clause "Subject to^{depositing an} amount of Rs.3,00,0O0/- in the form^{of F.D.R. r,r'ith one surety.} The petitioner herein is accused No.1 in^C.C.No.15760 ol²⁰¹⁹ and the offences alleged against him are under Sections^498-4, 506 of IPC and Sections 4 and 6 of Dowry Prohibition Act, 196^1.

Heard the learned coltnsel lbr the pelitioner ancl learned Assistant Public Prosecr-rtor lbr the State. Perused lhe record.

The petitioner herein fi1ed an application under Section 451 of Cr.P.C in Crl.M.P.No.883 of 2O2l in C.C.No. 15760 ol 2019 to return his Passport for interim custody. Vide order dated. 14.12.2021, learned XIII Additional Chief Metropolitan Magistrate, Hyderabad allowed the said application on certain conditions including the condition of depositing an amount of Rs.3,00,000/- in the form of FDR with one surety. Learned counsel for the petitioner would submit that the petitioner is suffering with cancer and he is not in a position to deposit the said amount of Rs.3,OO,00O I -. ln proof of the same, he has filed medical reports.

A perusal of the medical recpoerts would reveal that the petitioner is suffering with cancer. According to the learned counsel, the condition of depositing Rs.3,00,000/_ in the form of FDR with one surety is on higher side and the seeks to reduce the same.

Considering the above said facts, the said condition of depositing Rs.3,00,000/- in the form of FDR with one surety is reduced to Rs. 1,50,000/- and all other conditions remain unaltered.
