Heard learned counsel for the petitioner / owner of the goods and learned public prosecutor. perused the Record. With their consent this Criminal petition is disposed of, at the admission stage.

Petitioner herein is claiming to be the owner of the goods, i.e., HDpE laminated woven sacks with liner for packing suphala, filed this petition to reiease the said sacks. The petitioner herein is not an accused in Crime No.10g2 of 2O2l of Vanasthalipuram police Statiol. The offence alleged against the accused therein are under Section 2o(b)(ii)(C) of NDPS Act.

Perusal of the record would reveal that petitioner herein has not filed any application before the Court below under Section 4Sl r/w.457 of Cr.p.C., seeking relief as sought in the present petition.

In view of the same, this Court is not inclined to grant relief to the petitioner herein. Therefore, this Criminal petition is dismissed. However, liberty is granted to the petitioner herein to file appropriate application under Section 451
