Venkateshwara Agencies from the year 2016-17 till date in connection with the investigation in Crime No.26212021 of Nizamabad lV-Town Police Station, Nizamabad District, in the interest of^justice.

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 aggrieved by the order of the I Additional ludicial First Class Magistrate, Nizamabad vide Crl.M.P.No.108 of 2022 refusing to direct the investigating officer in Crime No.262 of 202t to procure certain income tax returns pertaining to M/s.Venkateshwara Agencies from the year 2016-2017 and also the bank statements pertaining to the said agencies after the year 2016.

Heard learned counsel for petitioner/Complainant, learned Assistant Public Prosecutor for 1tt and 2nd respondents and Sri.Ch.siddhartha Sarma learned counsel for the 3'd respondent. Perused the record.

Learned counsel appearing for the respondent No.3 submits that pursuant to filing of this application all the documents which are with the 3'd respondent have already been submitted. However, some of the documents could not be given for the reason of the 3'd respondent ceased to be a paftner from the year 2017. He further submits that, Iearned counsel for the petitioner has received the

docunrents^provided by the 3'd respondent counsel, however, insists that the income tax returns of the year 2020-21 and 2021-22 were not made available.

In view of the above, since the 3'd respondent ceased to be a

partner in the said firm, the said documents could not be made available. Needless to say, the petitioner/complainant has other

remedies under law to secure those documents.

Accordingly, this criminal petition is closed.

As a sequel thereto, miscellaneous applications, if any

pending, shall stand closed.
