clients who are interested inpurchase of gold from ICIC Bank. Accordingly, the secondrespondent gave some ref'erences to him. He contacted his o1d client A-2for purchaseof gold and A-2, in tum, gave reference ofhis friend A- 1, who evinced interest to purchase puregold of99.99 purity. A-1 had given account number and chequebearing No.098887dated 10.11.2012 fbr Rs.3,33,021/-, but the saidaccount onverif-rcation, Mr.I-Iarshavardhancame to know that the account given by A- I is his mother's (A-4) accountwhere the balance available in that account was Rs.89,9521-only. The second respondentconveyed the same to A-1,who assuredthat the amount will be deposited in an hour and he willhandoverA-4's cheque in a couple of days, as it needs to be signedby A-4.Later, A-1 deposited Rs'3lakhs in A-4's account andthe bank could completethe transactionby debiting the amount .fromA-4's account on the same day by trusting A- 1 thathe wilt handover the chequeto the bank in a couple of days. Subsequently,Mr.Harshavardhanhad given 100 gms gold to thesecond respondentto deliver it to A-lOn the instructions of A-1, thesaid gold was deliveredto A-2, but A-1 failed to give the cheque,as promised, in two days.A- 1 purchasecl
