I.A.No.2 of 2022 is filed under Order VI, Rule 17 read with Section i 5 1 of Civil Procedure Code (for short 'CPC') to permit the petitioner to amend thc prayer in I.A.No.1 of 2O2l wherein it is mentioned as respondent No. 15 instead of respondent No.12. Having regard to the submissions made by learned counsel on both sides, as the respondents did not object the same and that the partiA have already filed compromise petition, I am inclined to accept the request of the petitioner. Accordingly, this application is allowed, prayer part in I.A.No.l of 2022 is permitted to be amended, respondent No.15 may be read as respondent No.12. There shall be no order as to the CoStS.

In view of terms of compromise in Item No.1 of suit schedule property in Sy.No.114 of Ganugopahad Village, Jangaon Revenue Mandal respondent Nos.l to 4, who are the plaintiff Nos. I lo 4 in O.S.No.52 of 2010, agreed to forego Ac.lO.24 guntas in Northern side in lavour of appellant Nos. 1 to 3 and respondent No.12 herein and that they are only entitled for the remaining extent of Ac.2.13 guntas. As far as item Nos.2 and 3 of suit schedule property are concerned, the decree and judgment of the tria.l Court holds good. With this modification, the judgment and decree dated

Sandeep yadav, Advocate for the Respondent No.12 Appellants and said respondents through their respective Advocates having fired in r'A'No'1 0f 2022 requesting the court to pass a decree in terms the memorandum of compromise entered into between them and upon perusing the grounds appeal, judgment and decree of the lower court and the memo of compromise purporting to have been signed by the parties and their Advocates and fired with the said l.A.No.1 0f 2022 and it appearing from the said memorandum of compromise that the parties herein have entered into

compromise and settled the matter out of court in terms memorandum of compromise filed herein.

This Court DOTH RECORD the terms of the said memorandum of compromise in original whereof is filed in the said l.A.No.1 of 2022 of and a copy whereof is annexed hereto and DOTH in terms of the'said memorandum of compromise declare Order and Decree as follows:

'1 . That the Appeal Suit be and hereby disposed of in terms of memorandum of compromise in l.A.No.1 of 2022.

fhat the respondent Nos.1 to 4, who are plaintiff Nos.1 to 4 in O.S.No.52 of 2010 on the file of Senior Civil Judge, Jangaon, agreed to forego Ac.10-24 guntas on the Northern Side in respect of item No.1 of the Suit Schedule property in Sy.No.'1 14 of Ganugopahad Village, Jangaon Revenue Mandal, in favor of appellants^'1 to 3 and Respondent No.1 2 herein and they are only entitled for remaining extent of Ac.2-13 guntas;

That the^judgment and decree of the trial Court in respect of item Nos.2 & 3 of the Suit Schedule property holds good;

That subject to above modification, the^judgment and decree dated 25.04.2017 in O.S.No.52 of 2010 passed by Senior Civil Judge, Jangaon is confirmed; and

That there shall be no order as to costs in this Appeal.
