This Writ^{Petitionis filed questioning the action of the} 2nd respondent^{in issuingProceedings,dated 20'08'2020,suspendlng the} authorization^{of the petitionerFair Priceshop No.33842020of Balanagar} Circle.

Heard learned^{counselfor the petitionerand learned Government} Pleader for Civil^{Supplies appearingfor the respondents and withtheir} consent, the^{writ Petition is takenup for hearing and disposalat the stage} of admission.

The^{petitionercontendsthat the respondentsby theimpugned} proceedings have suspended^{the authorizationof the petitionerFair Price} Shopforindefiniteperiod,withoutspecifyingtheperiodofsuspension' Whicnactionisnotpermissible.Itisfurthercontendedthat,evenafter issuance of^{the impugnedproceedings,the respondentsdid not initiate} anyactlonagainstthepetitioner,WhichitselfmakestheContinuationof the impugned^{proceedings, for a periodof more than one year, illegal'} 4.Percontra,learnedGovernmentPleaderforCivilSuppliessubmits thatundertheControlorders,thereisnoperiodSpecifiedWithinwhich time the respondents^{are requiredto initiatefurther action,in pursuance} of the suspension^{made, Learned Government Pleaderwouldfurther} submit that,^{since the petitioneris claiming thatshe wasunableto run the} Fair Price Shop^{on account of her ill-health, it is alwaysopen for the} petitioner to approach the^{respondent authorities by makinga} representation,^{enclosing therewith alt the medical certificates,seeking} revocation of the^{suspensionand re-allotting the cardholders,who were}

Having^{regard to the submissionsmade' and withoutgoinginto the} merits or demerlts^{of the claim being madeby the respective parties'} since it^{is claimedby the petitioner that on accountof her ill-health' she} WaS not^{able to run the Fair Price Shop,this CourtiS of the view that the} petitioner can^{be permittedto approachthe respondent authoritiesand} make a^{representation seeking revocation of the suspension made by the} impugned^{proceedings'dated 20 08'2020'enclosingtherewith all the} necessary^{documentsin supportof her claim of ill-health'within a period} of two^{(2) weeksfrom the dateof receiptof a copy of this order.up.n} the^{petitioner makingsuch representatlon'the respondentauthorities} shall consider^{the same' in accordancewith law' however' keeping 1n view} the^{pandemic Covid- 19 that had prevailed duringthe perrod' after} affordlng^{an opportunityof hearingto the petitioner' wrthin a further} period of two^{(2) weeks lherefromand communrcatethe decisionthereon} inWritingtothepetitionerasexpeditiouslyaspossible.
