Petition under Article 226 of rhe constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High court may be pleased to issue a wirt or order preferably in the nature of writ of Mandamus and after calling for records pertaining to the impugned Memo No.22B3lAt2o1B-7, dated 12t7121 passed by 1st Respondent declare the impugned order to the extent of not considering the date of appointment of the petitioner as Assistant professor, General Medicine i.e. 1-3-98 and considering only from the date of appointment as Assistant Professor, cardiology, i.e. 2311112003 and consequently rejecting the objections of the Petitioner as illegal, arbitrary, contrary to |aw, and unconstitutiona I and quash the same and consequently declare that the petitioner is entitled to count his seniority in the category of Assistantprofessor, from the date of his appointment as Assistant Professor, General Medicine, with effect from 1-3-1 9gg instead of from the Date of Appointment as Assistant professor cardiology 2311112003 and consequen y direct the 1st Respondent to prace the petitioner at seriar No.33 or at appropriate prace taking into consideration the date of Appointment of the petitioner as Assistant Professor Generar Medicine with effect from 1-3-9g in the Finar seniority List of Professors communicated vide the impugned order and consequenfly quash the Reasons for Rejection/consideration of objections of the impugned order pertaining to the Petitioner as contrary to rure, contrary to Law and u nco nstitutio na l and consequenfly direct the 1st Respondent to consider and promote the petitioner to the next higher Post of Additionar Director of Medicar Education/principars of Medicar colleges/S u perintende nt of Teaching General Hospitals with all consequentia I benefits like arrears of pay, seniority etc.
