The^{grievanceof the petitionerin the Present writ petitionis} that^{the respondents have blacklistedthe petitioner for a period of} three^{years ort the ground that the PPE kits supplied by the} petitioner^{do not meet the specified standards and therebyseeking} to recover^{an amountof Rs'2' 1 Crores from the biils payableto the} petidoner'

He^{further submitsthat this Court by order dt 28'01'2021} directed^{the respondents to draw another s&mple in the presence} of the^{petitioner from the PPE lots already supplied by it and send} the^{same fortesting toSouth India Textile Research} Association(SlTRA)'^{Coimbatore'and obtain report from the said} agency;^{that the said agencysubmitted the test report' which}

shows^{that the PPE Kits supplied by the petitioner meeting all the} quality^{parametersspecrfied;and that the impugned proceedings} cannot^{be saidto be issued validly'}

Counter^{affidavit on behalf of 2nd respondent is filed wherein} 2'd respondent^{admit to havingdrawna sample as directed by this} Court on^{28.01'2021andsendingthe same to SITRA for testingon} 13.02.2021.^{Further, along with the counter filed' a copy of the}

test report^{dt.19'02 2021 has been enclosedas receivedfrom the} said testing^{agency,indicating that the sampledrawn and sent by} the resPondents^for testing having^{met allthe parameters} specified.

Since the^{PPE Kits suppliedby the petitionerhave met the} standards prescribed,^{the basis forissuing the impugned} proceedings dt. 15,0i.202¹ stands^{removed. In view of the same,} the action of the respondents-authorities^{inblacklistingthe} petitioner for a period of three years and denying amounts to the petitioner payable for the supplies already made by it cannot be surstained.

For the foregoing reasons, this Writ Petition is allowed; the impugned proceedings dt. 15.01.2021 in Lr.No.O3/Ph3/ QC/NSQ/PPE^{Kits Testing/2020-21} of^2na respondent is set aside; and it is held that the petitioner is entitled to receive the payment for the supplies made by it. No order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand closed.
