This is an application for anticipatory bail. The petitioner is accused No.3 in Crime No.6 of 2021 pending on the file of Kubeer Police Station, Nirmal District. The offences alleged against the petitioner are under Sections 304-B, 306 and 498-4 read with 34 IPC hnd Sections 3 and 4 of the Dowry Prohibition Act.

Heard Mr. M.A.K. Mukheed, leamed counsel for the petitioner and the leamed Public Prosecutor for the respondent. Perused the record.

Learned counsel for the petitioner would submit that there are no allegations much less specific allegations against the petitioner. The de facto complainant, brother of the deceased, irnplicated the entire family of the accused No.l - husband of the deceased. The petitioner is a lady and is aged about 58 years.

Learned Public Prosecutor, on instructiorrs, would submit that the Investigating officer has recorded the statements of l4 witnesses and also 2 official witnesses. The investigation is almost cornplete. The police have already arested al1 the accused except the petitoner-A3 and they were released on bail.

and is aged about 58 years, this Court is inclined to grant anticipatory bail to the petitioner - accused No.3.

Accordingly, the Criminal Petition is allowed and the petltloner A.3 is granted anticipatory bail on the following conditions:

i) The petitioner - accused No.3 is directed to surrender before the Station House Olficer. Kubeer Police Station. t.-Nirmal District, within a period of fifteen (15) days frorn today. and on such surrender, the said Station House Officer,)shall release the petitioner - A3 on bail on her executing a personal bond for a surn of Rs. 10,000/- (Rupees ten thousand onl;-) with two sureties for a like sum each to the satisfaction of the said Station House Officer.

ii) The petitioner - accused No.3 shall abide by the conditions stipulated in Section 438 (2) of Cr.P.C and cooperate with the Investigating Officer in investigating the crime.

iii) The petitioner - accused No.3 shall personally appear before the concerned Investigating Officer on every Sunday between 10.00 AM and 5.00 PM, till completion of investigation and filing of final report.

Miscellaneous petitions, if any pending, shall stand closed.
