Mandal,throughthe RevenueInspector, in the year 2000 clearly disclosethat the defendants and their agnatesare cultivatingthe said land and enioyingphysical possessionof the said landtill date. They further submitted that the persons claiming tobe the legai representativesof late Syed Mohamood Farooq Miyanwithout their knowiedgeand in coliusion with the Revenueauthoritiesgot mutated their names in the Revenue recordsas Pattadarsand obtainedpassbooks and title deeds. Theyalso contended that it is settled principle of law that underROR Act, the pattadar,who is not in possession of the land, isnot entitled for issuance pass books and title deeds' They also contendedthat when the defendants are in possessionof the land to an extentof Acs'2-16gts' in Sli 'No'439' there is nonecessifyto interferewith the alleged development work of the plaintiff.It is alsoconter-rdedthat the plaintiff in collusion withthe alleged land ownersis tryingto grab the land of thedefendants and it is only a developerand GPA holder of the landowners and, therefore,the present suit filed by the plaintiffis not maintainable.
