Heard learned counsel for the petitioner and learned Standing Counsel appearing for the respondents.

Petitioner retired from service on 31.10.2015 on attaining the age of superannuation. After retirement he was re-employed and continued in service on re-employment till 30.06.2018. On 17.02.2017, petitioner made an application to the Director (PA&W), for payment of Settling-in-allowance, informing him the amount incurred by him for settling-in-allowance and requested him to pay the same. He has followed it up with several other representations. Alleging inaction, this writ petition is filed.

On instructions, learned Standing counsel, sought to contend that as petitioner retired from service on 31.10.2015, application for payment of settling-in-allowance was to be made within six months, from that date, whereas, such application was made for the first time only on 17.02.2017 and it is therefore, not maintainable.

In response, learned counsel for the petitioner points out that as per Rule 14.1 of Singareni Collieries Company Limited Travelling Allowance Rules, 2012, such application can be made, even after cessation of service on re-employment, whereas, petitioner made such application much prior to cessation of service. He would therefore, submits that the application is not belated.

Taking note of the provision in Rule 14.1, the Writ Petition is disposed of directing the respondents to consider the application submitted by petitioner on 17.02.2017 and reminders submitted thereafter, the copies of which are enclosed as Exs.P.14 to P.17, to take decision and communicate the same to the petitioner, within a period of four weeks from the date of receipt of copy of this order. Pending miscellaneous petitions, if any, shall stand closed.
