This Criminal Petition, under Section^{438 of the Code of} Criminal Procedure, 1973^{(for short,'Cr.P.C.'), is filed by the} petitioner/accused for grant of anticipatory^{bail in Crime No' 37 of} 2O2O of Penchikalpet Police Station,^{KomarambheemAsifabad} District, registered for the offence^{punishable under Section 420 of} IPC.

Heard the learned counsel^{for the petitioner/accused,the} learned Additional Public^{Prosecutor for the respondent/State and} perused the record.

In the course of^{submissions, it isnoticed that the} petitioner/accused has not filed a similar^{bail application beforethe} court of session. There^{are no special or exceptional circumstances} to deal with this application by this^{court.Underthese} circumstances, the learned counsel^{for the petitioner/accusedseeks} permission of this Court to withdraw this application^{with a liberty to} file a similar bail application before^{the Court of Session.}
