Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be^pleased to extend interim orders in CMA No.769 of 2009 dated 2l-7-2009 in the interest of justice, Pending disposal of CMA No. 769 of 2009, on the file of the High Court.

Petition under Order 43 Rule 1 of CPC, praying that in the circumstances stated ln the grounds filed in support of the Civil Miscellaneous Appeal, the High Court may be pleased to set aside the decree dated 6-7-2009 passed in IA.No. 162 of 2009 in OS,No.110 of 2009 on the File of the Court of the I Senior Civil ludge, City Civil Court at Hyderabad by allowing the above CMA;

The Appeal coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and the order of the High Court order dated 21-0720009 in CMA No. 769 of 2009, the Court made the following.

During the course of hearing, learned counsel appearing for both the parties have submitted that since the original suit is of the year 2009, the same may be directed to be disposed of as expeditiously as possible, In the light of the aforesaid submission made by the counsel for respective parties, the LA. is disposed of with a direction to the learned 17th Additional Senior Civil Judge, City Civil Court, Hyderabad, to forthwith commence the trial in O.S,No,110 of 2009 and conclude it as expeditiously as possible, preferably within a period of Four months from today.

Parties are directed to appear before the Court of 17th Additional Senior Civil Judge, City Civil Court, Hyderabad in O.S,No,110 of 2009 on 30.11.2020 positively. The appellants are directed to deposit the rents regularly as directed by this Court, vide order dated 2t.O7,2OO9, till the disposal of O.S.No,110 of 2OO9. On such deposit, the respondents are at liberty to withdraw the same. Such deposit and withdrawal shall be subject to the result of the suit in O,S,No,110 of 2OO9,

As requested by the learned counsel for respondents orally, the appellants, instead of paying RS.5,OOO/- per week to the respondents, shall pay Rs,1O,OOO/- (Rupees Ten thousand) per week, commencing from 23,11,2020 onwards, till the disposal of O,S.No,1lO of 2009.
