ORDER:

This writ petition is filed with the following prayer:

“….to issue any appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 1^st Respondent in not issuing an original copy of the award dated 08.04.2019 on non-judicial stamp paper as arbitrary, illegal, unconstitutional and pass such further order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.”

Heard learned counsel for the petitioner, who submits that appeal filed by the petitioner is returned as award copy, which is given to the petitioner, is not engraved on non-judicial stamp papers.

Learned counsel for respondent No.1 submits that already nonjudicial stamps deposited by the petitioner are utilised for engraving original award, which is to be kept for record purpose and petitioner was given copy of award as envisaged under the provision of Arbitration and Conciliation Act, as such, the petitioner cannot have any grievance.

Learned counsel for respondent No.2 also made similar request as that of the petitioner.

Though several contentions are raised, after hearing the parties, this Court is of the opinion that the request of the petitioner can be accepted, because there is no provision prohibiting issuance of copy of the award to the petitioner to be engraved on non-judicial stamp papers.

In view of the same, the writ petition is disposed of permitting the petitioner as well as respondent No.2 to make a request to the Arbitration Commission along with required stamp papers for issuing copy of the award to the petitioner engraved on the non-judicial stamp papers as well as to respondent No.2 and on such request necessary action to be taken in this regard.

Miscellaneous petitions pending, if any, shall stand closed. No
