Aggrieved by the dismissal of his original application by the Andhra Pradesh Administrative Tribunal, the petitioner, who is working as a School Assistant (Social Studies), has come up with the above writ petition.

Heard Mr. M. Srikanth, learned counsel for the petitioner. Learned Government Pleader takes notice for the respondents. 3. The grievance of the petitioner is that at the time of transfer counselling, he ought to have been considered as a person working in category-IV School and awarded points accordingly for considering his case for allotment to another School. But the respondents considered him to be working in a category-III School, thereby depriving him of the points that he is entitled.

The Tribunal dismissed the Original Application forcing the petitioner to come up with the above writ petition.

Learned counsel for the petitioner brought to our attention to a set of Rules known as Andhra Pradesh Teachers (Regulation of Transfers) Rules issued by the Government in G.O.Ms.No.31 School Education dated 31.05.2017, in which there is a provision under Rule 21 for filing a appeal. Therefore, learned counsel sought permission to file an appeal in respect of his grievance. Therefore, the writ petition is disposed of permitting the petitioner to file an appeal in terms of the aforesaid Rules. Upon such appeal being filed, the appellate Authority

may consider the same with reference to the Rules, and on merits and

pass appropriate orders in accordance with law.

As a sequel thereto, miscellaneous petitions, if any, pending
