CRIMINAL PETITION No.2524 of 2018

ORDER :

This Criminal Petition is filed seeking relaxation of conditions which were imposed against the petitioner, while granting bail to him vide Crl.M.P.No.1043/2014 in the order dated 12.06.2014 passed by the Principal Sessions Judge, Kurnool, the condition being, deposit of two original passports before the I.O.

Counsel for the petitioner submits that petitioner requires his passports, as he needs to attend his wife who is sick and he needs to visit Australia quite often. He also submits that the same condition was imposed in all the crimes registered against the petitioner and in Cr.No.18 of 2009, this court ordered for return of the passports. Counsel further submits that Rs.50 lakhs was deposited in the Crime in question before the lower court and that petitioner would not withdraw the said deposit.

Hence, considering the above, this Court opines that the said condition can be relaxed and the two original passports are directed to be released to the petitioner on condition of the petitioner continuing the deposit of Rs.50 lakhs which he made before the lower court. Apart from that, petitioner shall inform the Addl. Director General of Police, CID, whenever he proposes to leave the country.

Criminal petition is accordingly disposed of.

As a sequel, miscellaneous petitions, if any pending, stand closed.
