This petition is filed seeking for grant of anticipatory baii to the petitioner, who is sole accused, in Crime No.22 of 2018 on the file of Sircilla Police Station, Rajanna Sircilla District. The offences alleged are under Sections 42O, 479 and 506 IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The counsel for the petitioner submitsrthat the land in V disputerin this case is the subject matter of the writ petition, which was filed by the relatives of this petitioner in W.P.No.33709 of 2010 and that the complainant in this case is the son of the 5th respondent in the said u,rit petition. The subject matter of the said rvrit petition and this case is one and the same.

Hence, considering the above, this Court opines that it is a fit case for grant of anticipatorv bail.

Accordingly, the Criminal Petition is a11owed. The petitioner is directed to surrender before the Station House Officer, Sircilla Police Station, Rajanna Sircilia District, within 15 days from the date of this order. On such surrender, the petitioner shal1 be released on bail on his

executing a personal bond for a sum of Rs.10,O00/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer. Further, on such release, the petitioner shall abide by the conditions mentioned under Section a38(2) Cr.P.C., as under:

(i) The petitioner shal1 make himself available for interrogation by a police officer as and when required.

(ii) The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) The petitioner sha-ll not leave India without the previous permission of the Court.

As a sequel, miscellaneous petitions pending

consideration, if any, in this case shall stand closed.
