This Writ Petition is filed for a Mandamus to declare the inaction of the respondents, in disbursing 30% of the amount realized in pursuance of the lease of fishing rights in Baddipudi Tank as per G.O.Ms.No.22, Animal Husbandry, Dairy Development & Fisheries (Fish-II) Department, dated 22.03.2003, as illegal and arbitrary. The petitioner sought for a consequential direction to respondent Nos.2 and 3 to disburse the sum of Rs.6,98,000/- realized from the public auction held on 06-06-2011.

Respondent No.3 filed a counter-affidavit wherein he has admitted holding of auction of fishing rights for the Baddipudi Tank on 06-06-2011 and realization of the auction amount. He has also admitted the claim of the petitioner that he is entitled to receive a sum of Rs.6,98,000/- towards 30% of the auction amount as per the abovementioned GO. He has also stated that he has no objection for disbursement of the said amount.

At the hearing, the learned Assistant Government Pleader for Fisheries (AP) reiterated the above-mentioned contents of the counteraffidavit.

In the light of the above undisputed facts, respondent Nos.2 and 3 are directed to pay the sum of Rs.6,98,000/- to the petitioner within one month from the date of receipt of this order.

Subject to the above direction, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, WPMP.No.26964 of 2012, filed by the petitioner for interim relief, is disposed of as infructuous.
