2. The 1st petitioner states that he is the owner of the property of five mulgies with H.No.3-4-28/1 to 3-4-28/5 situated at Subashgan, Zaheerabad, Medak district. His father purchased the mulgies under the registered sale deed dated 17th Zur 46 fasli and after obtaining permission from the Municipality, they raised structures vide Permit No.26/1958. Subsequently, their mother was permitted to make further constructions vide Permit No.26-17-65, dated 17.02.1966. During 1968, the husband of the 3rd respondent got the name mutated without any basis, in the municipal records and on the application of the petitioner, the Municipality passed orders on 21.09.1973 directing removal of the name of the husband of the 3rd respondent and incorporating the name of the mother of the 1st petitioner. The 3rd respondent did not initiate any proceedings against the orders dated 21.09.1973. Subsequently, the 3rd respondent made an application to reopen the orders passed on 21.09.1973 and the 1st respondent after considering the issue directed the 3rd respondent to workout her remedies before the competent civil Court. While so, the 3rd respondent appears to have submitted another application and filed WP No.25961 of 2005 wherein a direction was issued by this Court directing the respondents to consider the representation dated 24.10.2005. After receipt of the said orders, the 1st respondent passed the impugned order mutating the name of the 3rd respondent in the municipal records. Challenging the same, the petitioners filed an appeal before the 2nd respondent on 21.03.2006 along with the stay petition.
