Petitioner states that his father was an exserviceman and consequently, he is eligible to get assignment of land in terms of G.O.Ms.No.6187/A3/479/52, dated 22-09-1952. He, however, states that his father was not allotted any land. He made representations to the District Collector- the third respondent herein seeking allotment of land to himself in the ex-servicemen category. Copy of one of the representations of the petitioner, dated 06-05-2013, is annexed to the affidavit filed in support of the Writ Petition.

The learned Government Pleader for Revenue, who had taken instructions from the respondents, submits that the Collector has called for report from the Revenue Divisional Officer on the said representation; that the Revenue Divisional Officer, in turn, got the request of the petitioner examined through Tahsildar and has sent a report to the Collector stating that the land sought for by

the petitioner in Survey Nos.465 and 53 of Maripeda Village is not available for assignment; and that the absence of any appropriate Government land for assignment was, accordingly, informed to the petitioner. The learned Government Pleader, therefore, submits that if the petitioner indicates any other land in the nearby villages, his request can again be considered by the Collector.

It is evident that request of the petitioner for assignment of land was considered by the respondents. However, it is not for the petitioner to insist on a specific land to be assigned. He has to take any available Government land nearby. Hence, the Writ Petition is disposed of giving liberty to the petitioner to make fresh application to the Collector indicating alternative survey numbers where he seeks assignment. If such request is received, respondent Nos.3 to 5 shall consider the same and shall expeditiously pass appropriate orders thereon in accordance with the policy of the respondent. No order as to costs.

As a sequel, WPMP.No.8017 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
