ORDER: (Per the Hon’ble Sri Justice Ashutosh Mohunta)
This writ petition is filed aggrieved by the show cause notice dated 03-02-2014 issued by the 4th respondent, whereby, the petitioners have been asked to file their objections along with documentary evidence to show that the human hair is meant for export.
The petitioners are the dealers in human hair which they purchase from different states and export to foreign countries.
Sri N.V. Ramanujam, counsel for petitioners states that all details along with documentary evidence have been submitted before the Deputy Commercial Tax Officer-III, Vijayawada, clearly showing that the human hair is meant for export and are not liable for any tax, yet no orders have been passed by the competent authority.
Learned counsel for the respondents however submits that as only show cause notice has been issued to the petitioners, therefore, the petitioners should await the decision of the competent authority before approaching this Court by filing the writ petition.
After hearing the counsel for the parties, we are of the considered opinion that only show cause notice dated 03-02-2014, has been issued by the 4th respondent and as the petitioners have already submitted all the relevant documents along with their objections before the 4th respondent, the 4th respondent is directed to deal with the objections by taking into
consideration all the relevant documents which the petitioners have filed, within a period of ten (10) days from today. Through this order, the petitioners are given liberty to personally appear before the 4th respondent on 10-03-2014.
With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.. Miscellaneous Petitions pending, if any, shall stand disposed of.
