When the appeals are taken up for hearing, it is reported that parties have settled the dispute among themselves and reduced the terms of settlement, in the form of Memo of Compromise, which is duly signed by both the parties and their respective counsel.
Both the parties are present along with their counsel. The counsel appearing for the parties identified them. Accordingly, the parties admitted the terms of compromise, as per which, Smt. K. Lalitha, sole respondent in C.C.C.A No.37 of 2009, agreed to pay a sum of Rs.18,00,000/- to Sri K. Rangachary, 2nd appellant in C.C.C.A. No.37 of 2009, towards full and final settlement of the claim, and handed over a cheque bearing No.001802, dated 30.04.2014, drawn on AXIS Bank. By virtue of the compromise, Sri K. Rangachary, 2nd appellant, delivered possession of schedule property, in question, to Smt. K. Lalitha, sole respondent.
It is further agreed by the parties that Sri K. Rangachary, 2nd appellant, has to shift his entire household material and vacate the same by 13.04.2014.
Accordingly, the Memo of Compromise is taken on record. Consequently, both the City Civil Court Appeals are disposed of in
terms of the compromise.
In consequence, Miscellaneous Petitions, if any, pending in these Appeals shall stand closed. No order as to costs.
