Heard Sri A.K.Jaya Prakash Rao, learned counsel appearing for the petitioner and learned Standing Counsel for the Andhra Pradesh State Road Transport Corporation appearing for R1 to R4.

This Writ Petition is filed seeking to declare the charge sheet issued by the 3^rd respondent vide proceedings dated 25.09.2014 and the transfer order passed by the 2^nd respondent vide proceedings dated 6.12.2014, as arbitrary and illegal.

The petitioner was appointed as Driver on 30.12.1993 in the respondent-Corporation in Kadapa Division and his services were regularized vide order dated 22.05.1997. While so, 3^rd respondent issued charge sheet to the petitioner on the allegation that during the course of dharna, he uttered unparliamentary words by criticizing one N.Padmavathi, Superintendent (Traffic), Badvel, for which, he submitted his explanation. On a report lodged by the said N.Padmavathi, a case in Cr.No.106 of 2014 was registered for the offences punishable under Sections

506, 509 read with 34 IPC. Thereafter, the petitioner was transferred from Kadapa Region to Kurnool Region. The said transfer order is questioned in this writ petition.

Sri A.K.Jaya Prakash Rao, learned counsel appearing for the petitioner invited the attention of this Court to the report submitted by the Member of the N.G.O Sexual Harassment Committee, to whom the matter was referred for enquiry and submitted that a perusal of the report would reveal that the petitioner did not use any abusive language against N.Padmavati. Learned counsel further submitted that in view of the said report, the transfer order passed

by the 2^nd respondent is in violation of principles of natural justice and it is in the nature of punishment which requires to be set aside.

On the other hand, learned Standing Counsel appearing for the respondents submits that the transfer order dated 6.12.2014 shows that the petitioner resorted to some misconduct on several occasions and the transfer was made on the administrative grounds and therefore, it does not require any interference by this Court.

Considering the submissions made by the

learned counsel appearing for both the sides, and also the fact that the petitioner was transferred from Kadapa Region to Kurnool Region, which causes some hardship to him, the Writ Petition is disposed of directing the petitioner to make a representation to the 2^nd respondent requesting him to transfer to any place in Kadapa Region and on receiving such representation, the 2^nd respondent is directed to consider and dispose of the same, within a period of two weeks from the date of receipt of a copy of this order.
