This Writ Petition is filed aggrieved by the order, dated 18.10.2012, in O.A.No.7898 of 2012, passed by the Andhra Pradesh Administrative Tribunal, Hyderabad.
It is submitted by the learned counsel for the petitioners and the learned counsel for respondent No.1 that the subject matter of this Writ Petition is squarely covered by an earlier common order passed by a Division Bench of this Court in W.P.Nos.40625 of 2012 and 3403 of 2013, dated 11.10.2013, and a copy of the said order is placed on record.
A perusal of the aforesaid order, dated 11.10.2013, shows that earlier, the Tribunal passed a common order, dated 16.10.2012, in O.A.Nos.7702 & 7789 of 2012, since the issue involved in both the O.As. is one and the same. Against the order passed in O.A.No.7702 of 2012, W.P.No.3403 of 2013 was filed before this Court, which was allowed by order, dated 11.10.2013. The present impugned order was passed basing on the common order, dated 16.10.2012. Therefore, as the subject matter of this Writ Petition is squarely covered by the earlier order, dated 11.10.2013, following the same, this Writ Petition is also allowed and the impugned order, dated 18.10.2012, is set aside and the matter is remitted to the Tribunal for fresh consideration in accordance with law, along with O.A.No.7702 of 2012. It is also made clear that if any interim orders are required, it is open to the petitioners to move the Tribunal for appropriate directions.
Miscellaneous Petitions, if any, pending in this Writ Petition,
shall stand closed. No costs.
