It was the grievance of the petitioner before the Tribunal that for the posts of LFL Head Master, as per the orders of the Government, counselling was scheduled on 15.10.2012, but, before holding such counselling, though the vacancy is available at MPPS, GML, Namburu, Pedakakani Mandal, Guntur District, the third petitioner issued proceedings, dated 13.10.2012, promoting the first respondent and posting him at MPPS (Main) Veldurthy, Veldurthy Mandal. The Administrative Tribunal having noticed that on the date of considering the case of the first respondent herein for promotion to the post of LFL Head Master, there were 16 teachers eligible for promotion and the first respondent stood at Sl.No.1 and in the list of vacancies as on 12.10.2012, the vacancy at MPPS, GML, Namburu, Pedakakani Mandal, Guntur District, was also available and by recording a finding that the first respondent was denied the opportunity to choose his placement in the counselling, allowed the O.A. by the impugned order directing the petitioners herein for posting him as LFL Head Master in the vacancy available at
