Katkam Narsaiah Vs The District Collector, Karimnagar District, Karimnagar.

The short grievance of the petitioners, who are the existing Fair Price Shop dealers of Karimnagar District, is that pending the appeal before respondent No.5, respondent No.2 has been proceeding with filling up of the vacancies created due to bifurcation of the existing Fair Price Shops.

The fact that the petitioners have filed an appeal against the order of bifurcation made by respondent No.1 and that the same is pending before respondent No.5 is not disputed by the learned Government Pleader for Civil Supplies.

In my opinion, if the newly created shops are allowed to come into existence pending the appeal, the appeal itself will become fait accompli. In this view of the matter, respondent No.2 is directed not to finalise the selection and appointment of Fair Price Shop dealers for newly created shops, pending disposal of the appeal by respondent No.5. Respondent No.5 is directed to dispose of the appeal within one month from the date of receipt of this order, after notice to the petitioners.

Subject to the above directions, the Writ Petition is disposed of.

As a sequel, WPMP.No.39656 of 2014 filed by the petitioners for interim relief stands disposed of as infructuous.
