calling volunteers amongst the regular serving employees with a minimum of three years of service in different categories of Operating Department including Pointman “C” for filling up of 16 vacancies of Goods Guard in PB-1. The applicant was eligible for the said promotion and submitted his application. The authorities finalized the list of eligible candidates on 17.1.2013 and declared 38 candidates as eligible including the name of the applicant. After finalization, the name of the applicant was not shown in the empanelled list, dated 23.7.2013, issued by petitioner No.1 herein. Aggrieved thereby, the applicant along with 18 others filed O.A.No.977 of 2013 before the Tribunal and the same was dismissed on 10.12.2013. Aggrieved thereby, he along with two others filed W.P.No.37232 of 2013 before this Court and the same was allowed on 6.2.2014 directing the authorities to prepare a fresh selection list duly taking note of the minimum period of three years of service in the grades in the feeder category for giving the said promotion. So, the authorities prepared a panel vide memo, dated 24.4.2014, containing the names of eight candidates. Serial No.7 shows the name of respondent No.3 herein, who retired on 31.3.2014 after attaining the age of superannuation. Aggrieved with the preparation of the said panel, the applicant filed O.A.No.549 of 2014 questioning the action of the authorities in including the name of a retired candidate for promotion. The same was disposed of directing the petitioners herein to exclude the name of respondent No.3 from the panel and finalize the selection by including the next meritorious candidate in his place. Hence, the present writ petition.
