proceedings dated 10.07.2003 for providing 24 hours power supply to industrial consumers on certain terms, the petitioner applied for the same and the respondents sanctioned the 24 hours power supply scheme to the petitioner’s stone crushing unit at the estimated value of Rs.3,63,110/-. As per the said sanctioned plan, the petitioner unit has to consume 13,354 units within 12 months and pursuant to the same, the petitioner has to pay half of the estimated amount. In accordance with the conditions of the sanctioned scheme, the petitioner paid Rs.1,81,560/- i.e. 50% of the total estimated amount. To implement the 24 hours continuous power supply scheme to the petitioner’s stone crusher unit, it required erection of 11 KV line with 34 square M.M. A.A.A. conductor over proposed 8.00 mts. P.S.C.C. poles at an average span length of 60 meters, erection of 200 x 11 KV in line AB switch and erection of DP for mounting of line AB switch. The respondents arranged the same to the petitioner to facilitate 24 hours 3 phase supply to its unit. In regard thereto, the petitioner entered into an agreement with the respondents under the sanctioned estimate. As per the terms of the scheme, the respondents have to provide 24 hours power supply to the petitioner-Unit and the petitioner-Unit has to consume the volume of energy at 1,60,248 units within 12 months period and in case, if the level of consumption falls below the estimated level, the petitioner has to pay the balance estimate charges of Rs.1,81,560/- to the respondents provided that the conditions of supply remain the same at 24 hours a day except at the time of power failure.
