ORDER:
Heard learned counsel for the petitioner and learned standing counsel for the State Election Commission.
2. The grievance of the petitioner is with respect to the correction of correct house number in his election I.D. and voter’s list. It is stated that petitioner is a resident and he is a voter in Ankapally Assembly Constituency and his name was also shown in the voter’s list of 2009. Petitioner states that his house number and residence, as recorded in Aadhaar and all other crucial documents, is 2-1-61. However, in the year 2014 voter’s list, the said
house number is shown as 2-1-62
in stead of 2-1-61 and since all his crucial documents show the correct house number, the mistake in the voter’s list and voter’s I.D. is required to be corrected. Petitioner states that he has already made a requisite application before the District Election Officer, Election Commission on 10.05.2014, Ex.P2, and also further representation to the District Collector, Ex.P3, dated 02.05.2014. Alleging inaction, the present writ petition is filed.
3. Learned Standing Counsel for the State Election Commission submits that the authority for correction of voter’s list is Chief Electoral Officer and the District Collector is the Chief Electoral Officer.
4. In the circumstances, therefore, the writ petition is disposed of directing the District Collector, who is the Chief Electoral Officer, to consider the petitioner’s representation, dated 02.05.2014, and pass appropriate orders thereon. Petitioner is also at liberty to make further supplemental representation, if he so desires, together with the documents he seeks to rely upon to enable the District Collector to take into consideration all the circumstances and pass appropriate orders on the request of the petitioner.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
