ORDER:
Heard learned counsel for the parties and with their consent, this writ petition is disposed of at the admission stage.
The bore well of the petitioner was seized by order dated 27.6.2014 of third respondent and the petitioner appears to have filed an appeal against the said order which is pending before the appellate authority-second respondent. The grievance of the petitioner is that no action is taken on the said appeal and in view of the seizure of the bore well, the petitioner is deprived of the use of water to the
standing crop of paddy.
Learned Government Pleader for Revenue, on instructions, submits that the appeal filed by the petitioner is fixed for hearing on 1.8.2014 before the second respondent.
In the circumstances, this writ petition is disposed of directing the second respondent to take up and decide the matter, at least the interlocutory application and pass appropriate orders thereon. The petitioner is at liberty to seek advancement of date of hearing of the matter before the second respondent, if he so desires.
Miscellaneous applications, if any, shall stand closed. No costs.
