The petitioner claims to have owned land to an extent of Ac. 2.54 cents, in Survey Nos.494/9A, 494/3, 494/2C2, 494/8D, 455, 494/3, 494/2A1 and 494/8B1, situated at Kukkalapalle Revenue Village, Yadamari Mandal, Varigapalle Gram Panchayat, Chittoor District. The petitioner pledged the above property with the State Bank of Hyderabad, Chittoor Branch, Chittoor District, to obtain loan. The petitioner became a defaulter and the amount of loan accumulated. With an understanding that the proceeds of sale of the land would be credited to the loan account, the bank permitted the petitioner to sell the land and, accordingly, the land was sold to respondents 3 and 4. Sale proceeds were deposited with the bank. The initial understanding was for one time settlement, but this did not work out and the bank refunded that amount. At this stage, the petitioner wanted the purchasers to re-convey the property by taking back the amount already paid to him. The purchasers have not agreed for such a proposal.
