This writ petition is filed challenging the action of the Andhra Pradesh Administrative Tribunal, Hyderabad (for short, “the Tribunal”) in refusing to grant interim order in O.A.No.2295 of 2014 seeking to suspend G.O.Ms.No.39 Health, Medical & Family Welfare (J2) Department, dated 15.2.2014.

Petitioners/applicants filed the aforementioned Original Application before the Tribunal to declare G.O.Ms.No.336 Health, Medical & Family Welfare (C2) Department, dated 24.11.2011, and consequential G.O.Ms.No.39, dated 15.2.2014, insofar as it seeks to make all the employees, who have been appointed after undergoing regular process of selection on contract basis, to undergo selection again as illegal and arbitrary, and further direct the respondents to regularize the appointment of the applicants in accordance with the proposal/recommendations of the respondents pending before the Government and to set aside G.O.Ms.No.39, dated 15.2.2014, till the applicants’ case for regularization is considered. As the Tribunal refused to grant interim order in the Original Application suspending G.O.Ms.No.39, dated 15.2.2014, the applicants filed the present writ petition.

3. Learned counsel for the petitioners/applicants stated that a Division Bench of this Court, vide order, dated 8.5.2014, in W.P.No.14411 of 2014, granted interim orders directing the respondents therein to maintain status quo with regard to filling up of

vacancies pursuant to orders in G.O.Ms.No.39, Health, Medical and Family Welfare (J2) Department, dated 15.2.2014.

4. In view of the changed circumstances, the petitioners ought to have filed another application before the Tribunal to pass a similar order. Hence, we do not find any reasons to admit the writ petition.

Accordingly, the Writ Petition is dismissed at the stage of admission giving liberty to the petitioners to file another application bringing to the notice of the Tribunal the interim order, dated 8.5.2014, in W.P.No.14411 of 2014, passed by this Court and the Tribunal is requested to pass appropriate orders on the said application in accordance with law. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
