Intermediate in Telugu Medium in March 2010, B.Sc., with Mathematics as optional subject in English Medium in April 2003, passed Urdu as another language under Part1B in B.A Degree examination held in April 2004, B.Ed., from Moulana Azad National (Urdu) University in Urdu medium in September 2012 and also he passed S.S.C in Urdu Medium in March, 2004. The applicant was qualified and eligible to hold the post of School Assistant (Maths) (UM) as per the Rule 4(2)(vi)(a) of the Recruitment Rules issued vide G.O.Ms.No.4, Education (PE-SerII) Department, dated 09.01.2012, Rule 5(1) of Andhra Pradesh School Educational Subordinate Service Rules issued vide G.O.Ms.No.12, School Education (Ser-II) Department, dated 23.01.2009, the orders of the Andhra Pradesh Administrative Tribunal in 8615 of 2009 and 2341 of 2009, and the orders of the Division Bench of the High Court in W.A.No.878 of 2009, dated 05.03.2010. The first petitioner herein instead of selecting and issuing appointment orders to the applicant as School Assistant (Maths) (UM), sought clarification from the DSE for his selection. The applicant approached the Andhra Pradesh Administrative Tribunal and filed Original Application No.9706 of 2012, against the said impugned action of the respondents and the Tribunal in the said Original Application passed a detailed order on 13.12.2012, directing the respondents to consider the case of the applicant for selection and appointment to the said post. The applicant submitted representations to the first and second petitioners herein enclosing the interim orders of the Tribunal, but instead of considering his case for selection and appointment as School Assistant (Maths) (U.M) in DSC-2012, the first petitioner herein issued the impugned rejection order dated 17.12.2012 and hence, he filed Original Application No.10075 of 2012.
