WRIT PETITION NO.10848 OF 2009

ORDER:

This Writ Petition was filed by one Basetti Amrutha Bai represented by her General Power of Attorney (“GPA” for short) Holder Basetti Hari Babu challenging the action of the first respondent in recording the name of the second respondent in the Municipal Records in respect of premises bearing H.Nos.2-3-236 and 2-3-237 situated in Jagtial, Karimnagar District, without due notice to the petitioner.

The GPA Holder and the second respondent are none other than the sons of Basetti Amrutha Bai.

Learned counsel for the second respondent now filed an affidavit of the mother stating that the Writ Petition was filed by the third son without intimating about filing of the Writ Petition against her youngest son, the second respondent. She also stated that she cancelled the GPA through a Deed of Revocation of GPA registered as Document No.1 of 2014 dated 06.02.2014 and a copy of the same is enclosed to her affidavit.

However, learned counsel, who is appearing for the GPA Holder, submits that since the GPA was withdrawn, a notice should go to the petitioner.

But, in view of the affidavit filed by the petitioner herself enclosing a copy of Registered Deed of Revocation cancelling GPA alleged to have been executed in favour of one of her sons, who filed the present Writ Petition on behalf of his mother, I feel it is not necessary to issue a notice to her.

In the circumstances, the Writ Petition is dismissed giving liberty to Basetti Amrutha Bai to move this Court, if she is aggrieved otherwise and as and when the circumstance warrants. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
