2. The petitioner firm is the manufacturer of Locks with the brand name “Sheel Security Products”, Nizam Shahi road, Hyderabad, for the last several years. It was running the business after obtaining the registration certificate from the 1st respondent for their manufacturing activity. Rule 1(3) of the Stands of Weights and Measures (Packaged Commodities) Rules 1977, applies to the commodities in the packaged form. Rule 6(A)(iii) provides that no declaration as to the month and the year in which the commodity is manufactured or pre-packed shall be required to be made on any package contain metallic product. Since the products of the petitioner firm are metallic products, they do not require the declaration or display of the month and the year of manufacture. The Standards of Weights and Measures (Enforcement) Act, 1985 and Rules framed there under, came into force in the State of Andhra Pradesh with effect from 21.04.1988 and 15.07.1989 respectively. It is their case that Section 33(2) of the said Act, 1985 contemplates the State Government to make Rules, to regulate the packaging of any commodities intending to be sold or distributed within the State in packaged form or to regulate the sale or distribution within the State or any commodity in packaged form. Since no rules are made by the State of Andhra Pradesh, the Standards Act and the Rules made there under are applicable to the petitioner firm. Rule 6 of the Standards of Weights and Measures (Packaged Commodities) Rules 1977 were amended with effect from 25.09.2001 omitted the proviso (A), clauses (i) to (v). But the said amendment is applicable only for inter-State trade and commerce and the said Rules of 1977 are made applicable to the State of Andhra Pradesh.
