In the Singareni Collieries, various categories of workers are employed. At the unskilled level, the employment starts with General Mazdoors Category-I. The post next higher to that, is General Mazdoor (GM) Category-II. The Singareni Collieries Automobile Workers’ Association made a representation to the Management, stating that the employees in GM Category-I must be allowed the pay scale of the post of GM Category-II, on completion of a fixed length of service, without subjecting them to any skill test. The Management did not accede to the request. As desired by the Workers Association, the Government of India, Ministry of Labour, referred the dispute under Section 10 (1)(a) and Section 2(A) of the Industrial Disputes Act, 1947 to the Industrial Tribunal, Hyderabad. Through its award, dated 29.05.1993, the Tribunal took the view that 78 General Mazdoors in Category-I of the Area Auto Workshop, Godavarikhani, mentioned in the reference, are entitled to be promoted to Category-II, without the necessity of conducting any tests or interviews. Challenging the award, the Company filed W.P.No.745 of 1994 before this Court. A Learned Single Judge dismissed the writ petition through order, dated 12.06.2003. Hence, this writ appeal by the Company.
