Order: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta)
It was submitted in the morning that identical issue involved in this Public Interest Litigation is pending adjudication in Writ Petition No. 9025 of 2011. We called for the records and checked up whether the issues are one and the same. It appears that the unofficial respondent in the Public Interest Litigation has filed the writ petition resisting his eviction and the learned Single Judge by order dated 7.4.2011 has passed an order protecting against the eviction as an interim measure. The above writ petition was filed earlier in point of time.
Under the circumstances, we close this Public Interest Litigation giving liberty to the petitioner, if so advised and permissible under law, to intervene in Writ Petition No. 9025 of 2011, which is pending.
Consequently, the miscellaneous applications, if any pending, shall also stand closed. No order as to costs.
