F.C.A.No.303 of 2013 is filed under Section 19 of the Family Courts Act, 1984, aggrieved of the judgment and decree dated 14.03.2011 passed in O.P.No.543 of 2009 by the Additional Family Court, Visakhapatnam, whereby the said O.P., filed by the appellant under Section 13(1)(i)1(a) of the Hindu Marriage Act, seeking decree of divorce, is dismissed.

F.C.A.M.P.No.40 of 2014 is filed in the appeal, seeking to record compromise between the appellanthusband and the respondent-wife, stating that they have settled the matter and to dispose of the appeal in terms of the memorandum of compromise, which is enclosed along with the petition. As per the memorandum of compromise, the

appellant-husband agreed to pay an amount of Rs.13,50,000/- (Rupees Thirteen Lakh Fifty Thousand only) to the respondent-wife as full and final settlement. On the said terms, they agreed to get their marriage dissolved by a decree of divorce. Learned counsel for the appellant-husband handed over four demand drafts totalling an amount of Rs.13,50,000/-, to the learned counsel for the

respondent-wife, who has acknowledged the same. The appellant-husband and the respondent-wife who were present in the Court have stated that they have settled the disputes amicably and requested to dispose of the matter in terms of the memorandum of compromise.

In view of the request made by the parties and in the light of the memorandum of compromise arrived at by the parties, F.C.A.M.P.No.40 of 2014 is allowed, granting decree of divorce. Consequently, F.C.A.No.303 of 2013 stands disposed of in terms of the memorandum of compromise, without reference to any of the allegations made by the parties against each other, and the marriage solemnized between the appellant and the respondent hereby stands dissolved. The memorandum of compromise shall form part of the decree of divorce. Miscellaneous petitions if any pending stand closed. No order as to costs.
