This appeal, under Section 19 of the Family Courts Act, is filed by the appellant/defendant against the judgment and decree dated 27.07.2005 in O.S.No.82 of 2003 passed by the Family C o u r t , Hyderabad, allowing the suit filed by the respondents/plaintiffs seeking maintenance.

2. Appellant is the defendant and respondents are plaintiffs in the suit O.S.No.82 of 2003. For the sake of convenience, in this appeal, the parties are referred to as they are arrayed in the suit before the Court below.

3. The aforesaid suit was filed by the plaintiffs, who are wife and son of the defendant, for grant of past and future maintenance at Rs.5,000/per month each. Originally, O.P.No.665 of 2002 filed by the plaintiffs as indigent persons was allowed and pursuant thereto the suit filed by the plaintiffs seeking maintenance was numbered as O.S.No.82 of 2003.

The plaintiffs filed the said suit stating that plaintiff No.1 is the legally wedded wife of the defendant and their marriage was solemnized on 27.8.1993 at Saleem Function Hall, Lakdikapool, Hyderabad, as per Muslim rights and customs, for a deferred dower of Rs.15,000/- with 4 Dinar-e-Sharai. It is alleged that at the time of marriage, the defendant was given Rs.2,100/- as cash dowry and sufficient Jahez articles. It is alleged that the defendant used to insist and indulge in unnatural sex and as she has not agreed for the said act, the defendant used to beat her

mercilessly. It is alleged that on 20.4.1994 the defendant, his mother and sister drove plaintiff No.1 from the matrimonial house and since then she is residing with her parents. On 10.10.1994 plaintiff No.1 gave birth to a male child, who is plaintiff No.2. As there was demand for dowry, a complaint was lodged before the police, who registered a case for the offence under Section 498-A of I.P.C. and the defendant was prosecuted for the said offence. It is further alleged that the defendant is working as a Bucherman in Australia and drawing a salary of Rs.2,500/- Australian Dollars per month, which is equivalent to Rs.30,000/- per month in Indian Currency and hence claimed a sum of Rs.5,000/- per month towards past and future maintenance and to create charge over the house bearing No.1-6-843, Musheerabad, Hyderabad owned by the defendant.

5. The defendant contested the suit by filing his written statement, wherein he denied various allegations made by the plaintiffs. He disputed the paternity of plaintiff No.2 and denied the allegation that he is working as a Bucherman and drawing a salary of Rs.2,500/- Australian Dollars per month. He also denied ownership of house bearing No.1-6-843, Musheerabad, Hyderabad and getting rental income from such house property.

6. Before the Court below, on behalf of the plaintiffs, plaintiff No.1 was examined as P.W.1 and got marked Exs.A.1 to A.8. On behalf of the defendant, the defendant himself was examined as D.W.1 and marked Exs.B.1 to B.9. The Court below, after appreciating the oral and documentary evidence on record, by impugned judgment and decree dated 27.7.2005 partly decreed the suit and awarded past maintenance of Rs.1,500/- per month to plaintiff No.1 from 15.9.1999 to 14.8.2002 and held that she is entitled to same maintenance from 14.8.2002 to 10.6.2003; and

plaintiff No.2 was awarded past maintenance of Rs.1,000/- per month from 15.9.1999 to 14.8.2002 and from 14.8.2002 he was awarded maintenance at the rate of Rs.1,500/- per month. However, the Court below rejected the plea of the plaintiffs to create charge over the 1^st Floor of house property bearing No.16-843, Musheerabad, Hyderabad, on the ground that the ownership of the defendant in respect of the said house was not proved. Aggrieved by the said judgment and decree, the defendant has filed the present appeal.

7. Heard Sri Basith Ali Yavar, learned counsel appearing for the appellant-defendant. There is no representation for the respondents-plaintiffs.

8. The main submission made by the learned counsel for appellant-defendant is that plaintiff No.2/son has become major and as such he is not entitled for maintenance. He also submits that the amount of maintenance awarded by the Court below to plaintiff No.1-wife is exorbitant.

9. In this case, it is to be noticed that the parties are Muslims and their marriage was solemnized on 27.8.1993. It is clear from the evidence on record that during the relevant time, the defendant left to Australia and worked as Bucherman. Even during the cross-examination of defendant as D.W.1, he deposed that he pronounced triple talak to plaintiff No.1 on 10.6.2003 from Australia under Ex.B.5, the translation of which is marked as Ex.B.6. He also deposed that he sent the Maher amount of Rs.20,800/- and expenditure of Rs.2,125/- and also maintenance during iddat period under Ex.B.7. It is well settled that under Muslim Law, even after separation, the wife is entitled for maintenance. It is the specific allegation of plaintiffs that the defendant was earning a salary of Rs.2,500/- Australian Dollars

per month, which is equivalent to Rs.30,000/- per month in Indian Currency. Inspite of the same, the Court below has ordered only Rs.1,500/- per month for plaintiff No.1/wife towards past and future maintenance and awarded Rs.1,000/- per month towards past maintenance and future maintenance of Rs.1,500/- per month to plaintiff No.2/son. In view of the evidence on record, we are of the view that the quantum of maintenance awarded by the Court below cannot be said to be exorbitant, as pleaded by the appellant/defendant, and the same do not call for any interference.

10. At the same time, from the evidence on record, it is clear that plaintiff No.2/son was born on 10.10.1994 and during the pendency of the proceedings, he attained majority. In that view of the matter, we hold that plaintiff No.2/son is entitled for maintenance till the date on which he attained majority and thereafter he is not entitled for the maintenance. Therefore, the impugned judgment and decree of the Court below stands modified to that effect. In all other respects, the impugned judgment and decree shall remain unaltered.

11. Accordingly, the appeal is allowed in part. As a sequel, miscellaneous petitions pending, if any, in this appeal shall stand closed. No order as to costs.
