ORDER:
This Civil Revision Petition is filed under Article 227 of the Constitution of India, questioning the docket order dated 27.03.2014, passed by the Junior Civil Judge, Banswada, in I.A.No.41 of 2014 in O.S.No.10 of 2014.
Heard.
The grievance of the petitioner/2nd defendant in the suit is that the Court below had granted an ad-interim injunction in I.A.No.41 of 2014 in O.S.No.10 of 2014 on 27.03.2014. Counter-affidavit has been filed on 09.05.2014. Inspite of the fact that the counter-affidavit has been filed in I.A.No.41 of 2014, the Court below is not disposing of the said I.A which is causing great injury to the petitioner/2nd defendant.
Considering the grievance of the petitioner, I deem it appropriate to direct the Court below to dispose of the I.A.No.41 of 2014 in O.S.No.10 of 2014, after hearing both the parties within a period of four weeks from today.
Accordingly, the Civil Revision Petition is disposed of directing the Court below to dispose of the I.A.No.41 of 2014 in O.S.No.10 of 2014, after hearing both the parties, within a period of four weeks from today. There shall be no order as to costs.
Miscellaneous Petitions pending, if any, in this revision petition shall stand dismissed. No order as to costs.
