A counter-affidavit and an additional counter-affidavit dated 27.08.2014 has been filed by the Chief Engineer Mr. M. Siddaiah, S/o. Mallaiah, who is arrayed as a 3rd respondent in the Contempt Case. As per the counter-affidavit, the petitioners were not engaged by the Management of the Corporation but they were the employees of ‘M/s. Master Engineers’, who was arrayed as 5th respondent in the writ petition. There is no privity of contract between the petitioners and the Corporation. The allegation that the respondent-Corporation is engaging other contract labour replacing the people working presently under contract basis, has been denied. Further A.P. GENCO had issued notification dated 05.01.2011 and a supplementary notification dated 17.10.2011 for filling up of 1755 Junior Plant Attendants posts etc., and certain recruitments have already been made and in that view of the matter even with regard to the engagement of the contractors is required to be reconsidered. It has been categorically stated that considering the interim order dated 09.05.2013 passed by this Court, clarification dated 23.04.2013 was issued clarifying that the Gate Passes to be issued to all the persons whose cases are covered by the interim orders, subject to the condition of subsistence of the contract of the contractor with whom the workmen are working. In para No.5 of the additional counter-affidavit, it has been stated that the duration of the work which is entrusted to ‘M/s. Master Engineers’ is subsisting from 15.06.2014 to till date.
