This Criminal Revision Case is filed under Sections 397 and 401 Cr.P.C by the petitioner-victim’s(Pilli Jyothi) brother, having been aggrieved by the order dated 24.06.2014 in Crl.A.No.307 of 2014 passed by the learned Metropolitan Sessions Judge at Hyderabad confirming the order, dated 29.03.2014 passed by the learned Special Judicial First Class Magistrate for Excise Cases, Hyderabad in Crl.M.P.No.73 of 2014 in Cr.No.25 of 2014 wherein the victim was directed to undergo custody for a period of six months at Prajwala Rescue Home, at Charminar, Hyderabad from the date of the passing of that order.

Whether the impugned order dated 24.06.2014 in Crl.A.No.307 of 2014 passed by the learned Metropolitan Sessions Judge at Hyderabad confirming the order, dated 29.03.2014 passed by the learned Special Judicial First Class Magistrate for Excise Cases, Hyderabad in Crl.M.P.No.73 of 2014 in Cr.No.25 of 2014 is unsustainable and requires interference by this Court while sitting in appeal, if so, with what observations?

The learned Magistrate by impugned order, ordered the Prajwala Rescue Home, Cahrminar to give counselling to the victim and also take steps for her rehabilitation by training her some avocation in which she is interested and also provide basic necessities, for a period of six months from the date of that order. As the training is competed in Prajwala Rescue Home for six months as stated by the representatives of the said Home though it would otherwise be by 29^th of this month (September,2014), the Prajwala Rescue Home to leave the victim to join

her brother and sister by submitting her before the Magistrate where the brother and sister of the victim shall attend and execute a bond for Rs.20,000/- each and the learned Magistrate shall pass appropriate orders including for appearance to know her progress and reformation for any further necessity to commit to any Care Home, else to stay with her brother and sister who wants to perform her marriage to lead happy marital life. Accordingly, point No.1 is answered. Point No.2:

5.In the result, the Criminal Revision Case is disposed of directing the Prajwala Rescue Home to leave the victim to join her brother and sister by submitting her before the Special Judicial Magistrate of First Class for Excise Cases, Hyderabad (the trial Court) where the brother and sister of the victim shall attend and execute a bond for Rs.20,000/- each and the learned Magistrate shall pass appropriate orders including for appearance to know her progress and reformation for any further necessity to commit to any Care Home, else to stay with her brother and sister who wants to perform her marriage to lead happy marital life. Consequently, miscellaneous petitions, if any, pending in this revision, shall stand closed.
