CRIMINAL PETITION No.9970 of 2014

ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973, seeking quashing of all further proceedings in C.C.No.262 of 2012 on the file of the Judicial First Class Magistrate, Anaparthi, East Godavari District. A charge sheet came to be filed against the petitioners for the offences punishable under Section 498-A read with 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Though the present Criminal Petition is filed seeking quashing of the proceedings, the learned counsel for the petitioners restricts his prayer seeking dispensation of the presence of the petitioners before the trial Court on the ground that the first petitioner is aged about 75 years and the second petitioner being the brother of the first accused are residing at Pandalapaka Village in Bicavole Mandal and it would be difficult for them to attend the Court on every date of adjournment.

The learned Additional Public Prosecutor submits that as there is no dispute with regard to identity of the petitioners, the presence of the petitioners can be dispensed with.

Having regard to the nature of allegations and the offences with which the petitioners are charged, the presence of the petitioners in C.C.No.262 of 2012 on the file of the Judicial First Class Magistrate, Anaparthi, is hereby dispensed with except on the dates when their presence is specifically required by the Court.

With the above direction, the Criminal Petition is disposed of at the admission stage.

As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand dismissed.
