ORDER:
This Criminal Petition is filed under Section 438 Cr.P.C. for grant of anticipatory bail. Petitioner is A-2 in Crime No.61 of 2014 of Bellamkonda Police Station, Guntur District, for alleged offence under Section 307 read with 34 IPC.
2. Heard both sides.
3. I have perused the material papers filed along with the quash petition. Considering the submissions of both sides and the material available on record, instead of deciding the matter on merits, I feel that this petition can be disposed of by directing the petitioner herein, i.e. A-2 to surrender before the Court concerned and move for regular bail application and on that the learned Magistrate shall consider the bail application on merits and dispose it of on the same day without being influenced by disposal of this application.
4. Accordingly, this petition is disposed of directing the petitioner to surrender before the Court concerned and move for regular bail application and on moving such application, the Court below shall consider the same and decide it on merits on the same day without being
