ORDER:-
This Criminal Petition is filed by the petitioner/Accused, under Section 482 of the Code of Criminal Procedure, 1973, seeking quashing of proceedings in C.C.No.474 of 2013 on the file of Judicial Magistrate of First Class at Metpalli, Karimnagar District. A charge sheet came to be filed against the petitioner for an offence punishable under Section 324 IPC.
The learned counsel for the petitioner seeks permission to withdraw the criminal petition with a liberty to file an application for discharge before the trial Court.
Permission as sought for is accorded and, accordingly, the criminal petition is dismissed as withdrawn, giving liberty to the petitioner to file an application for discharge, in case the charges are not already framed in the trial Court and the trial Court shall dispose of the same, in accordance with law.
Consequently, miscellaneous petitions, if any pending, shall stand dismissed.
